A new Decree establishing the seat and jurisdiction of courts for Intellectual Property

Decree nº2009-1205 enacted on the 9th of October 2009 establishes the seat and the jurisdiction in matters relating to intellectual property.

"art. D. 211-6. The "Tribunal de Grande Instance" (TGI- Court of 1st Instance) of Paris has exclusive jurisdiction on actions relating to patents, utility patents, additional certificates, and topographies of semiconductor products, in cases and under the conditions provided for by the Intellectual Property Code.”

“art. D. 211-6-1. The seat and jurisdiction of TGIs having exclusive jurisdiction on actions relating to copyright, designs, trademarks, geographical indications, in the cases and under the conditions provided to by the Intellectual Property Code are established in accordance with table VI appended to the present code.”

This new decree will enter into force on November 9, 2009.
